Fee-Simple Title
What makes Cottonwood Creek unique is that the fee-simple title of owners grants the owner exclusive rights ONLY to their dwelling and the land under the dwelling. A lot is defined as the areas under the building and includes everything from the outside building material (brick, stucco, etc.) inward. The lot may include a patio and/or the area under a deck. The lot of each house is given a legal definition in the deed. There are currently 42 lots in Cottonwood Creek (17 in Phase I and 25 in Phase II).
Each owner also has a pro rata share (1/42) in the Common and Limited Common Property areas. The amount of interest each owner has in the Common and Limited Common Property is equal to the number of lots (42).
Common and Limited Common Areas
The Common and Limited Common areas include all the land within both phases that are not dwellings.
Limited Common areas are those parts of a property that the owner of a specific lot primarily uses. This includes sidewalks and driveways.
By covenant, each property owner has been assigned the reponsibility to maintain all of the Common and Limited Common areas within Cottonwood Creek to a neighborhood association. That association is known as Cottonwood Creek neighborhood Association, Inc. (CCNA), a South Carolina Corporation. The association has a Board of Directors (of no less than three members) and has an annual meeting (usually in the spring).
The association assesses monthly dues to all lot owners.
